ATLANTICA PRIVATE CHEFS - CHEF TERMS & CONDITIONS
By giving your confirmation, putting a check mark on the check box on ‘book a chef’ form or simply visiting our website you are indicating you agree with our terms and conditions. These may be changed at any time without notice. The following agreement is written for guidance and potential employment protection. We ask that you accept our Terms and Conditions before the process starts, not to inconvenience you, rather to make sure that there are no surprises and so that you end up a satisfied client.
Atlantica provides private chef training for experienced and qualified private chef candidates from all over the world and chef placement consultancy for the houses, private estates, luxury ski chalet, private and corporate events, professional events in any location in the World.
You acknowledge that you do not acquire any rights to reuse the content, layout and data in any manner. Use of the website and its data is governed by these terms and conditions. The data presented by the company is protected under international copyright laws.
The company makes all reasonable efforts to ensure that the information presented to Employers is accurate prior to forwarding information to an employer; however, due to the fact that the data is being entered by individual chefs from various locations, it is agreed that no guarantee as to the accuracy of information presented is expressed or implied.
Definition of Terms
- Company, Atlantica, Us, We, Our, Chef Agency: Atlantica, operated by Deniz Kurt, is an Italian registered consultancy company providing private chef training for experienced and qualified private chef candidates from around the world, as well as chef placement consultancy services for private residences, private estates, luxury ski chalets, private events, corporate events and other professional engagements worldwide.
- Chef, Candidate: Any person or company submitting their information on the website, making verbal presentations to Company personnel, or otherwise indicating their desire to find employment through the Company.
- Registration: The process undertaken by chefs seeking work to submit their details to the company.
- Employer, Client, Customer, You, They : Employer, Client, Customer, You, They: Any person or corporation requesting consultancy services from the Company in relation to the search, selection and engagement of a Chef for a private residence, private estate, luxury chalet, private event, corporate event or other professional engagement. The Employer may be the owner of the property, the owner’s representative, a company, a company employee or an agent acting on behalf of the owner. Atlantica does not employ, engage or appoint Chefs and does not make hiring decisions on behalf of any Employer.
- Website: The Company website is www.atlanticachefs.com
- Job order: A request to find a chef received by Company personnel.
- Long-term chef placement: Any position which does not have a fixed end date or full time and fixed term permanent placements exceeding 6 months.
- Seasonal chef placement: Any position which has a fixed end date of employment exceeding 2 months but less than 6 months
- Temporary chef placement : Any position which has a fixed end date of employment less than 2 months.
- Events: Any position which has a fixed end date of employment less than 7 days.
- Chef profile / profiles / profile: Michelin starred and Award-winning chefs, Senior Private Chefs, Private chefs, which Atlantica categorizes chefs in its database.
- Category: Long-term, Seasonal, Temporary and Event categories determined according to the recruitment length of the chef and the number of guests of the employer / client.
- Validity: These terms and conditions are valid until amended by the company and can be amended at any time.
- Chef Coordinator: Company staff who match chefs to specific job criteria.
Atlantica Discrimination Policy / Blacklist Policy
- 'Atlantica Private Chefs' is a Chef placement and Consultancy Agency which operates in a non discriminatory manner across gender, sexuality, race, religious beliefs, age and disability. We welcome all applications from people of all backgrounds.
- Atlantica does not operate a ‘blacklist’ of any kind.
Chef Agreements
- Chefs after giving their confirmation by putting a check mark on the check box indicating they agree with our terms and conditions. Indicate their agreement with these Terms which also indicates they have read and understood them. If chefs choose not to accept these Terms and will not be able to register and be represented by us.
- Atlantica, as part of its services, conducts preliminary candidate screening, reviews résumés, carries out interviews, performs reference checks and confirms candidate availability. However, Atlantica shall not be responsible for the management of the relationship between the Chef and the Employer following employment, nor for the conduct, behaviour or attitudes of the parties towards one another, or for any dispute, disagreement or conflict that may arise between them.
- Atlantica acts solely as a placement consultancy agency. Atlantica is not the employer of any chef. Iintroduced through its services and shall not be responsible for: salaries, taxes, social, security, contributions, insurance, occupational, health and safety, work permit, visa matters, repatriation costs, employment disputes, payroll administration. All such obligations remain exclusively with the Employer and the Chef.
- Atlantica does not employ chefs. It is the Employer responsibility to hire the chef for long term and short term employment according to the laws of the country where they are located. Atlantica does not make any payment to Chefs. After the commencement of the business relationship between the Chef and the Employer, the Chef and the Employer are responsible to each other in terms of any material and moral demands arising from the business relationship between them. Atlantica provided the parties with the necessary information to comply with the Social Security and Tax obligations in accordance with the laws of the country where the business will be performed. No liability can be attributed to Atlantica for failure to fulfill these obligations.
- Atlantica does not pay the chefs. We ask that our clients pay the chefs directly on an hourly, daily or a monthly basis at a rate and frequency agreed with Atlantica prior to the commencement of their engagement.
- No chef / candidate will be charged for registering or being represented by Atlantica. The agency fee incurred during the recruitment process is solely paid by the client.
- Atlantica makes sure that candidates are equally offered opportunities to the positions available through the chef coordinator.
- We offer candidates help and advice regarding the presentation of their CV, career advancement, interview techniques and personal presentations, advice for training, future training and any other assistance we can reasonably give.
- All information contained within the CV is to the best of the chef's knowledge correct.
- All the qualifications and references uploaded are chef’s property and the information contained within is correct and not been falsified or edited in any way.
- The Chef agrees that Atlantica may use, store, process and share the information contained within the Chef’s CV, application forms, references, certificates, photographs and other documents provided by the Chef for the purposes of recruitment, candidate representation, employment placement, reference verification, qualification verification and related recruitment activities. The Chef further agrees that such information may be disclosed by Atlantica to prospective Employers, former Employers, referees, clients and other relevant parties where reasonably necessary for the purposes of securing employment opportunities, verifying employment history, verifying qualifications, verifying references or otherwise facilitating the recruitment process. The Chef warrants that all information and documentation provided to Atlantica is accurate, complete and truthful to the best of the Chef’s knowledge. The Chef agrees to indemnify and hold harmless Atlantica from any loss, damage, liability, claim, cost or expense arising out of any misrepresentation, omission, inaccuracy or false statement made by the Chef.
- Chefs are required to take original copies of all their documentation with them for the Client’s records and inspections once employment has commenced.
- Atlantica merely introduces and connects Chefs with Employers and/or Employers’ Representatives. No employment relationship exists between Atlantica and any Chef. Accordingly, Atlantica shall not be responsible for unpaid salaries or fees owed to the Chef, nor for the occupational health and safety of the Chef. All such responsibilities belong exclusively to the Employer, Client or Employer’s Representative.
- Atlantica has informed and advised the Employer, Client, Employer’s Representative and Chef of the importance of entering into a written employment agreement. Where the parties choose not to enter into a written agreement, or where the parties fail to comply with any applicable tax, social security or employment-related obligations, despite such advice and information having been provided by Atlantica, Atlantica shall bear no responsibility or liability whatsoever in relation thereto.
- The Employer is responsible for all travel and incidental expenses incurred in transporting the Chef to and from the place of employment, including a private residence, private estate, chalet, event venue or any other agreed work location.
- The Client may organise a trial cooking for Long-Term or Seasonal Chef Placements in order to assess the suitability of a Chef Candidate. Trial cookings may be organised for one (1) or two (2) consecutive days only. The Client shall pay the Chef Candidate directly on a daily basis. The daily fee requested by the Chef Candidate for the trial cooking shall be communicated to the Client by Atlantica and/or by the Chef Candidate. All transportation and accommodation expenses of the Chef Candidate, including but not limited to flights, trains, buses, taxis, airport transfers and hotel accommodation, shall be borne entirely by the Client. During a one-day or two-day trial cooking, the Client may request lunch, dinner, or both. The Chef Candidate shall prepare menus according to the cuisine, menu style or specific dishes requested by the Client. The Chef Candidate shall advise the Client regarding the estimated shopping budget required for the trial and shall organise the necessary shopping. The Client shall provide the required budget for ingredients and purchases and shall either provide suitable transportation or reimburse the Chef Candidate for transportation expenses incurred during the trial. The Client is required to make daily payments directly to the Chef Candidate for the trial cooking. Atlantica does not charge any consultancy fee for trial cookings. The Client is solely responsible for all payments due to the Chef Candidate.
- Atlantica does not offer free trial cookings under any placement category.
- Atlantica verifies, to the extent reasonably possible, that the Chef is either a citizen of the country where the employment will commence or holds the necessary right to work in that country through a valid work permit, visa or other applicable authorisation. Any verification carried out by Atlantica is limited to a review of the documentation provided by the Chef, including passports, visas and work permits. Atlantica does not guarantee the validity, approval or continued validity of any visa, work permit or immigration status and shall not be liable for any legal, administrative or immigration-related issues arising from the Chef’s employment, travel, visa applications or work authorisation.
- The Client agrees to take full responsibility for ensuring that appropriate insurance cover is maintained for the Chef where required. The Client, Employer or Employer’s Representative shall be solely responsible for the safety, welfare and well-being of the Chef from the commencement of the employment, including while at the private residence, private estate, chalet, event venue or any other agreed work location. Atlantica shall have no responsibility or liability in this regard.
- There shall be an eighteen (18) month cooperation period between Atlantica and the Chef, commencing on the date the Chef starts employment. During this period, Atlantica shall continue to represent the Chef in relation to employment opportunities arising directly or indirectly from the Chef’s placement through Atlantica, including where the Chef is recommended to third parties or offered employment by another client, employer or contact introduced through the existing employment relationship. In the event that the Chef receives any offer of employment, engagement or recommendation from a third party arising directly or indirectly from the employment relationship established through Atlantica, the Chef shall immediately notify Atlantica. Where such notification is made and a new employment relationship is established, Atlantica shall charge the applicable placement fee to the new client in accordance with its fee policy. If the Chef fails to notify Atlantica and accepts or facilitates such employment directly or indirectly, the Chef shall be liable to pay Atlantica the applicable placement fee that would otherwise have been payable in respect of the new employment. The chef agrees, declares and undertakes that if he/she does not inform Atlantica about new employment offers contrary to this article and the employment is provided, he/she will pay the placement fee to Atlantica as a penal clause, which will be determined in accordance with the fee policy.
- Atlantica does not determine the salary of the Chef and does not negotiate the Chef’s salary on behalf of either the Chef or the Client. Atlantica may provide information regarding current industry salary ranges for guidance purposes only. It is the sole responsibility of the Chef and the Employer to discuss, negotiate and agree upon the terms of remuneration. Atlantica shall have no responsibility or liability whatsoever in relation to the salary agreed between the Chef and the Employer.
- For Events & Special Projects Placements, the Chef acknowledges and agrees that, after accepting an engagement through Atlantica, any unilateral cancellation by the Chef, except in cases of Force Majeure, shall give rise to the following obligations: If the Chef cancels the engagement more than one hundred and sixty-eight (168) hours before the commencement of the event, no penalty shall apply. If the Chef cancels the engagement less than one hundred and sixty-eight (168) hours before the commencement of the event, the Chef shall pay to Atlantica, as a contractual penalty, an amount equal to one hundred percent (100%) of the applicable Atlantica consultancy fee relating to that placement.
- Any cancellation request must be submitted to Atlantica in writing by email.
- Any cancellation based on Force Majeure must be supported by appropriate official documentation. Where the cancellation is based on medical reasons, the Chef shall provide medical documentation issued by a duly licensed medical practitioner.
- This cancellation policy applies exclusively to Events & Special Projects Placements and does not apply to Long-Term, Seasonal or Temporary Placements.
COMPLAINTS PROCEDURE
At Atlantica Private Chefs we pride ourselves on providing a personal, transparent and professional service. If you feel we have fallen short of these standards, we encourage you to contact us and we will do our best to resolve the matter promptly and fairly.

We will acknowledge receipt of your complaint within seven (7) business days and aim to investigate and resolve all complaints within twenty-one (21) business days.
ATLANTICA RESERVES THE RIGHT TO CHANGE OR AMEND OUR COMPLAINTS PROCEDURE WITHOUT PRIOR NOTICE.
UPDATING YOUR PROFILE
You agree to keep your profile and personal information accurate and up to date at all times. If no update has been made to your profile for a period of twelve (12) months, Atlantica may contact you requesting confirmation that your information remains current. If no response or update is received within thirty (30) days of such notification, Atlantica reserves the right to deactivate or remove your profile from its database in accordance with its Privacy Policy and applicable data protection laws.
Intellectual Property
- You are solely responsible for all communications and content submitted, uploaded or published on the Atlantica Private Chefs website through your login credentials.
- Atlantica has the right, but not the obligation, to correct, edit or remove any error, omission or content, as determined at its sole discretion.
- Atlantica respects the intellectual property rights of its members and requests that its users and members do the same. If you believe that your work is being copied in a manner that infringes your intellectual property rights, please contact Atlantica as soon as possible.
- All texts, images, logos and other elements appearing on the Atlantica Private Chefs website may not be reproduced, copied, distributed or used, in whole or in part, without the prior written consent of Atlantica Private Chefs.
- Any reproduction, whether in whole or in part, for advertising or commercial purposes, on any medium whatsoever, is strictly prohibited unless prior written consent has been obtained from Atlantica.

- We, as Atlantica Private Chefs, follow a company policy that respects your personal data and processes such data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable Italian data protection laws.
