ATLANTICA PRIVATE CHEFS - CLIENT TERMS AND CONDITIONS

By giving your confirmation, putting a check mark on the check box on ‘book a chef’ form or simply visiting our website you are indicating you agree with our terms and conditions. These may be changed at any time without notice. The following agreement is written for guidance and potential employment protection. We ask that you accept our Terms and Conditions before the process starts, not to inconvenience you, rather to make sure that there are no surprises and so that you end up a satisfied client. 

Atlantica provides private chef training for experienced and qualified private chef candidates from all over the world and chef placement consultancy for the houses, private estates, luxury ski chalet, private and corporate events, professional events in any location in the World.

You acknowledge that you do not acquire any rights to reuse the content, layout and data in any manner. Use of the website and its data is governed by these terms and conditions. The data presented by the company is protected under international copyright laws.

The company makes all reasonable efforts to ensure that the information presented to Employers is accurate prior to forwarding information to an employer; however, due to the fact that the data is being entered by individual chefs from various locations, it is agreed that no guarantee as to the accuracy of information presented is expressed or implied.

Definition of Terms

  • Company, Atlantica, Us, We, Our, Chef Agency: Atlantica, operated by Deniz Kurt, is an Italian registered consultancy company providing private chef training for experienced and qualified private chef candidates from around the world, as well as chef placement consultancy services for private residences, private estates, luxury ski chalets, private events, corporate events and other professional engagements worldwide.
  • Chef, Candidate: Any person or company submitting their information on the website, making verbal presentations to Company personnel, or otherwise indicating their desire to find employment through the Company.
  • Registration: The process undertaken by chefs seeking work to submit their details to the company.
  • Employer, Client, Customer, You, They : Employer, Client, Customer, You, They: Any person or corporation requesting consultancy services from the Company in relation to the search, selection and engagement of a Chef for a private residence, private estate, luxury chalet, private event, corporate event or other professional engagement. The Employer may be the owner of the property, the owner’s representative, a company, a company employee or an agent acting on behalf of the owner. Atlantica does not employ, engage or appoint Chefs and does not make hiring decisions on behalf of any Employer.
  • Website: The Company website is www.atlanticachefs.com
  • Job order: A request to find a chef received by Company personnel.
  • Long-term chef placement: Any position which does not have a fixed end date or full time and fixed term permanent placements exceeding 6 months.
  • Seasonal chef placement: Any position which has a fixed end date of employment exceeding 2 months but less than 6 months
  • Temporary chef placement : Any position which has a fixed end date of employment less than 2 months.
  • Events: Any position which has a fixed end date of employment less than 7 days. 
  • Chef profile / profiles / profile: Michelin starred and Award-winning chefs, Senior Private Chefs, Private chefs, which Atlantica categorizes chefs in its database.
  • Category: Long-term, Seasonal, Temporary and Event categories determined according to the recruitment length of the chef and the number of guests of the employer / client.
  • Validity: These terms and conditions are valid until amended by the company and can be amended at any time.
  • Chef Coordinator: Company staff who match chefs to specific job criteria.

Atlantica Discrimination Policy / Blacklist Policy

  • 'Atlantica Private Chefs' is a Chef placement and Consultancy Agency which operates in a non discriminatory manner across gender, sexuality, race, religious beliefs, age and disability. We welcome all applications from people of all backgrounds.
  • Atlantica does not operate a ‘blacklist’ of any kind.

EMPLOYER AGREEMENT

Employers after filling our ‘book a chef’ form and/or contacting us by email and/or by phone, they are indicating they agree with our terms and conditions. Indicate their agreement with these Terms which also indicates they have read and understood them. If the employer chooses not to accept these terms and will not be able to fill our form and/or receive our services.

  • It is agreed that the Employer appoints Atlantica to provide resumes of chefs to be considered for employment, and agrees to pay for services rendered Atlantica screens candidates, checks resumes, interviews candidates, checks references and confirms availability as part of our service, but cannot be responsible for the actions of candidates after hiring.
  • Atlantica does not employ chefs. It is the Employer responsibility to hire the chef according to the laws of the country where they are located. Atlantica does not make any payment to Chefs. After the commencement of the business relationship between the Chef and the Employer, the Chef and the Employer are responsible to each other in terms of any material and moral demands arising from the business relationship between them. Atlantica provided the parties with the necessary information to comply with the Social Security and Tax obligations in accordance with the laws of the country where the business will be performed. No liability can be attributed to Atlantica for failure to fulfill these obligations.
  • Atlantica acts solely as a placement consultancy agency. Atlantica is not the employer of any chef introduced through its services and shall not be responsible for: salaries, taxes, social, security, contributions, insurance, occupational, health and safety, work permit, visa matters, repatriation costs, employment disputes, payroll administration. All such obligations remain exclusively with the Employer and the Chef.
  • No chef / candidate will be charged for registering or being represented by Atlantica. The agency fee incurred during the recruitment process is solely paid by the client.
  • Atlantica makes sure that candidates are equally offered opportunities to the positions available through the chef coordinator.
  • All information contained within the CV is to the best of chef’s knowledge correct. 
  • All the qualifications and references uploaded are chef’s property and the information contained within is correct and not been falsified or edited in any way. 
  • Before Chefs are entered into Atlantica’s database system, Atlantica conducts interviews and preliminary screening procedures to assist in assessing whether candidates meet the Client’s requirements and hold the qualifications and documentation required for the position. Atlantica conducts reference checks where available and forwards resumes, written references (if any) and photo attachments provided by each applicant to the Client by email.

  • Chefs are required to take original copies of all their documentation with them for the clients records / inspections once they gain employment.

  • Some chefs work with their team. The company reserves the right to charge a second/third and more placement consultancy fee for the team or charge a total consultancy fee for the entire team when the chef coordinator makes the employer aware of the team status during the initial introduction.
  • Atlantica has made necessary enlightenment to Employer/Client, employer's representative and chefs about making the agreement in written form. In the case of not making the agreement in written form or In case of non-fulfillment of social security and tax liabilities in recruitment in all categories, despite our enlightenment, Atlantica does not have any responsibility .
  • You, the Employer, agree to hold as confidential the identity of the candidates submitted by the company and further agree not to pass on or otherwise distribute resumes or contact information for applicants received from the company to any other person, or corporation other than for the purposes of reference verification and employment suitability verification. Any violation of this cause is a breach of the agreement and the company shall be entitled to charge you for each candidate referred to a third party the equivalent consultancy fee that would have been incurred if the candidates had been hired by you.
  • The company assumes no authority to hire a chef on your behalf. Atlantica brings together the employer and the chef candidates suitable for the employer's demands. Employer / Customer is authorized and responsible for the employment of the chef and fulfillment of legal responsibilities.
  • Our recommendation does not constitute a guarantee that the chef is a perfect match for your program and the liability for the costs associated with interviewing, hiring and whenever necessary, repatriating chefs rests solely with the employer. Atlantica highly insists that all employers conduct detailed interviews and verifies all licensing and reference information before extending an offer of employment to any candidate.
  • Atlantica does not determine the salary of the chef, nor does it negotiate the salary of the chef with the client. Atlantica only informs the chef and the client the current industry salary range. It is the chef's responsibility to discuss and negotiate salary with the employer. No responsibility can be attributed to Atlantica for the salary of the chef.
  • Atlantica just gathers chef candidates and employer/ client, employer's representative, however there is no relation on the basis of Labor Law between chef candidate and Atlantica. For this reason, Atlantica is not legally answerable for the fees and/or salaries that are not paid to chefs and occupational health and safety of chefs. All responsibility in this regard belongs to the employer or employer's representative.
  • You warrant to indemnify and hold harmless the Company for any breach of data protection regulations caused by your failure to secure private information provided during this transaction with the Company and further warrant to return or destroy all resumes forwarded to you from the Company upon request.

FEE POLICY

  • A consultancy fee will be charged for any candidate that is employed as a consequence of or resulting from an introduction by Atlantica (whether direct or indirect) within 18 months from the date of the introduction. 
  • Atlantica does not pay the chefs. We ask that our clients pay the chefs directly on an hourly, daily or a monthly basis at a rate and frequency agreed with Atlantica prior to the commencement of their engagement.  
  • Long-term chef placement is any chef position to serve at the client's home, summer house, workplace and/or travels, which does not have a fixed end date or full time and fixed term permanent placements exceeding 6 (six) months. For placement under this category, the chef fee is calculated monthly. Atlantica’s consultancy fee for long-term chef placement is calculated as 6 weeks of the chef's monthly net salary and is paid by the client to Atlantica against an invoice.
  • Seasonal chef placement is any position which has a fixed end date of employment exceeding 2 (two) months but less than 6 (six)months. Atlantica’s consultancy fee for seasonal chef placement is 1(one) month net salary of the chef and is paid by the client to Atlantica against invoice.
  • Temporary Placement is any position which has a fixed end date of employment not exceeding two (2) months. For temporary placements Consultancy fee = twenty-five percent (25%) of the total agreed earnings during the employment period.
  • Events & Special Projects definition is any chef placement for private dining, celebrations, corporate functions, retreats, product launches, special culinary projects or events with a fixed duration. Fort his cathegory, Consultancy fee determined individually and agreed with the client before confirmation.
  • For the Events & Special Projects Placements categories, the client will be invoiced for the agency fee at any time after the candidate’s engagement has been confirmed by the client and/or on the day the contract is signed and must be paid one day before the event. Likewise, the payment of the chef must be made by the client on the day of the event or one day before the event. 
  • For seasonal and long term placements, the client will be invoiced for the consultancy fee at any time after the candidate’s engagement has been confirmed by the client and/or on the day our contract is signed. Atlantica asks that the consultancy fee must be paid within 14 days of the date of invoice or before the engagement commences whichever date comes first. 
  • If payment is not received within 14 days of the invoice date, interest of 10% per month will be charged on the outstanding amount until payment is received. Atlantico reserves the right to suspend all services, service credits and replacement guarantees until full payment has been made.
  • The client is liable to pay the bank charges for the payment of the consultncy fee.

CANCELLATION POLICY

  • Events & Special Projects: The Client may cancel the engagement free of charge up to one hundred and sixty eight (168) hours (7 days) before the commencement of the event. If the Client cancels less than one hundred and sixty eight (168) hours before the commencement of the event, the Client shall be liable to pay: a) 100% of Atlantica’s agreed consultancy fee; and b) 100% of the Chef’s agreed fee. All cancellation requests must be submitted to Atlantica in writing by email.
  • Long-Term, Seasonal and Temporary Placements The Client may cancel the placement free of charge up to fifteen (15) calendar days before the agreed commencement date. If the Client cancels the placement less than fifteen (15) calendar days before the agreed commencement date, the Client shall be liable to pay: a) 50% of Atlantica’s agreed consultancy fee; and b) 50% of the Chef’s first month’s agreed salary. All cancellation requests must be submitted to Atlantica in writing by email.
  • Postponement Requests If the commencement date of any placement or event is postponed by the Client, Atlantica and the Client shall agree upon a new commencement date. Should the originally selected Chef be unavailable on the revised date, Atlantica cannot guarantee the continued availability of the originally selected Chef. If the selected Chef is unavailable on the revised commencement date, Atlantica shall have no obligation to provide a replacement Chef free of charge and reserves the right to charge an additional consultancy fee for any subsequent placement. All postponement requests must be submitted to Atlantica in writing by email.
  • When a candidate has been chosen it is the employer’s responsibility to inform us within 48 hours of the conditions of employment; Must include candidate’s name & surname, position filled, start date and monthly/weekly or daily salary.

  • You can organize a trial cooking for long term and short term chef placements to decide about the right chef for your needs. Trial cooking can be organized only for a single day or two days. You pay the chef on a daily basis. The daily fee requested by the chef for the trail cooking will be notified to you. Transportation and accomodation costs (airways-train-bus-taxi-airport transfer-hotels) of the chef are fully under your responsibility. In a single day or two day trial cooking, you can try your chef candidate for lunch or dinner, or request both lunch and dinner. The chef candidate will prepare menus for you according to the cuisine you prefer to try, or the name of a meal. The chef will inform you of the budget of shopping and organize the shopping. You must allocate the necessary budget for shopping, provide your vehicle driven by your chauffeur or taxi expenses to the chef. Even if the chef resides in your town/city, you should organize the chef’s accommodation when you decide to try the chef for two days. You are required to make daily payments for the trial cooking to the chef. Atlantica does not charge any fees for trial cooking.
  • We offer no free trial period on any type of our placements.
  • All fees paid are non-refundable. Consultancy fee is the name of the fee given to the agency's service of finding the right candidate, entering advertisements in its own database and world's cv pools, screening and selecting candidates, conducting interviews, checking all references, and handling paperwork. It arises at the stage of choosing the right candidate. It is not a fee based on the performance of the person preferred by the employer after being hired. Therefore, the agency commission is non-refundable under any circumstances.
  • Atlantica finds a suitable chef for client’s demand and recommends the candidate to client. Client has sole discretion over employing the candidate. Atlantica has no responsibility if it seems that he / she is not a suitable candidate after the candidate is hired. In the event of finding the candidate employed insufficient or dismissing him/her from employment, no refund can be requested from Atlantica.
  • For Long-Term Placements, we offer Long-Term Chef Placement Service Credits. Atlantica allows the Employer a sixty (60) day probation period with the Chef. If the employment relationship is terminated by either party during the sixty (60) day probation period, Atlantica will provide the Employer with a full service credit for use against a future placement for up to three hundred and sixty-five (365) days from the date of invoice, subject to the limitations set out in Article 3.28.
  • For Seasonal Placements, we offer Seasonal Chef Placement Service Credits. Atlantica allows the Employer a thirty (30) day probation period with the Chef. If the employment relationship is terminated by either party during the thirty (30) day probation period, Atlantica will provide the Employer with a full service credit for use against a future placement for up to three hundred and
  • There are no credits available for temporary or any other chef placement categories.
  • In the Events & Special Projects category only, if the selected Chef becomes unavailable prior to the commencement of the engagement for any reason whatsoever, Atlantica shall use its best efforts to recommend and select a replacement Chef with qualifications and experience as close as reasonably possible to those originally requested by the Client. Atlantica shall not charge an additional consultancy fee for such replacement placement.If, despite Atlantica’s best efforts, no suitable replacement Chef can be secured before the commencement of the event, Atlantica shall refund 100% of the consultancy fee paid by the Client in relation to that placement. Refunds of consultancy fees are available exclusively for Events & Special Projects placements. No consultancy fee refunds shall be available for Long-Term, Seasonal or Temporary Placements. Any replacement rights applicable to Long-Term or Seasonal Placements shall be governed solely by the Service Credit provisions set out elsewhere in this Agreement. Atlantica shall not be liable for any additional losses, costs, damages or expenses incurred by the Client as a result of the Chef’s unavailability.
  • In case of termination of the business agreement of the chef in all categories for the reasons stated above, it is the Employer’s responsibility to mention Atlantica within 48 hours by email. This allows Atlantica to provide a new candidate to the employer. Atlantica is not obliged to place a new chef if the client does not inform Atlantica in writing by email within 48 hours.
  • Atlantica cannot promise to propose a new chef within 48 hours. Atlantica's ability to recommend a new chef to the client becomes difficult in some cases, depending on the chef profile the client wants. That's why Atlantica only promises to replace a chef as soon as possible. Atlantica needs the understanding of the client about deadlines. No liability can be attributed to Atlantica for failure to fulfill these obligations. 
  • There are no probation periods and service credits for events and special project placement categories. 
  • There is only one credit per all placements. The service credit is inapplicable in any of the following cases

1. If the event area has been changed by the client at the last 120 hours (5 days) before the event and the chef is not able to reach the venue.

2. If the event date has been changed by the client at the last 120 hours (5 days) before the event and the chef had no chance to join or organize him/herself. 

3. Major change in schedule from that planned at the time of hire. (Change of any of the terms agreed at the beginning) 

4. Failure by employer to maintain a safe working environment

5. Failure by employer to maintain a drug free workplace

6. Failure to pay within 14 days of invoicing

7. Failure to notify the company’s chef coordinator within 48 hours of chef departure.

8. When the employer is otherwise in default of this agreement

9. When the client doesn’t make payment to the chef, changing the salary of the chef by the client or deferring it. 

10.Where the Chef resigns due to conflict, harassment, bullying, discrimination, abusive conduct or a hostile working environment attributable to the employer or other employee, provided that reasonable evidence exists. Such evidence may include, without limitation, emails, text messages, messaging applications, photographs, social media communications or witness statements.

11.When the Chef accomodation conditions are not compatible with the originally agreed conditions.

12. In the event that the days off are not given under the agreed conditions. 

  • If a chef should not complete the probation period or chooses to not continue to work with the employer, and the Employer and chef come to an agreement to stay until another chef is placed by Atlantica or by another agent, it is the responsibility of the Employer to inform Atlantica within 48 hours and a 25% of the first week’s salary will be charged to the employer. 
  • If seaosnal placement is extended beyond the period for which the placement fee was originally calculated, Atlantica must be notified within 48 hours, we will issue an additional invoice for the remaining balance in line with Atlantica’s fee policy. 
  • When you employ a Chef from Atlantica for an event and the chef completes the event and then you offer the chef a seasonal, long term or any other position, it is the Client responsibility to contact Atlantica within 48 hours. You will be then charged the outstanding amount for a position you offer in line with Atlantica’s fee policy.  
  • When Atlantica submits chefs to you and you do not choose the chefs for that position at that time, however at a later date you choose one of the candidates, it is the client’s responsibility to contact Atlantica within 48 hours. The Client will be charged the applicable Introduction Fee in accordance with the fee policy.
  • The client cannot offer a job to any chef introduced by Atlantica without our involvement for 18 months from the date of introduction. In the event that any Chef introduced by us to the Client are employed or re-employed directly by the Client (with or without our involvement) within the period of 18 (eighteen) months from the date of our initial introduction of the Chef, the Client will be charged the applicable placement fee in accordance with the fee policy.
  • There is an 18-month period of cooperation between Atlantica and the chef, starting from the date of chef's employment. Atlantica will represent the Chef in all employment processes to be established by the employer who employs the chef through providing the chef a new occupation with another employer or recommending the chef to the third parties. As explained with the examples, in case of a job offer from a 3rd person/client/company/butler etc to the chef in regard to the employment relationship between the employer and the chef, the client and the chef will immediately notify Atlantica. If a new employment is provided as a result of the representation, Atlantica will charge a consultancy fee from the new client. The client accepts, represents and undertakes to pay Atlantica the consultancy fee to be determined in accordance with the commission policy as a penalty clause in case of mediating new collaborations in violation of this article and recommending the chef to the third parties and not informing Atlantica about this matter.
  • Should a chef be submitted by the Company and be previously known to the Employer, through introduction by another paid placement service, it is the burden of the employer to notify the company within 24 hours of receipt of the candidate’s information. If notification is not received within 24 hours then it shall be viewed as a valid introduction and consultancy fees payable regardless of if another invoice is deemed payable by the second agency. 
  • Should the employer also be searching for chefs online using web searches or listing services it is the burden of the employer to disclose the names of any chef already under consideration. Any chef submitted by the Company and hired, who has not previously been declared by the Employer will be viewed as a valid introduction and consultancy fees payable. This clause is to avoid an Employer using our service to validate the quality of a chef whose resume is online and avoid paying a fee. 
  • In situations where the candidate is known to the Employer but the Employer did not have the correct contact information and Atlantica provides this information to the client, the client is required to pay the full consultancy fee.

Other responsibilities: 

  • The Employer is responsible for all travel and incidental expenses in getting the candidate to and from the event area/house/private estate. 
  • Atlantica makes sure that a chef is a citizen of the country where the employment starts or she/he has the right to work in that country with a work permit and / or a short-term work visa. The examination made by Atlantica is a simple work permit, work visa and passport check, and no responsibility can be attributed to Atlantica due to the negativities/legal problems that may arise from the chef and the visa applications of the countries.
  • When we place a seasonal and long term placement candidate with you, that candidate will no longer be head-hunted by Atlantica, nor eligible for placement unless and until they have given you notice of their intent to depart. 
  • We will never knowingly extend offers to long term placement candidates that we have placed and collected payment. We will not approach seasonal placement candidates that we have placed unless the start date for the next position is after the end date that you have told us at the time of the job order.
  • By agreeing to these Terms & Conditions, the client agrees to take full responsibility and ensure that they have insurance cover to protect chefs and/or the client / employer or employer's representative are exclusively responsible for the safety and right to life of the chef candidate, after he/she joined the house, where the employment held, working area or event area. Atlantica does not have any responsibility in this matter. 
  • To the fullest extent permitted by law, Atlantica shall not be liable for any loss, damage, cost, expense, claim or liability arising out of or in connection with the recruitment, introduction, engagement, employment, performance, conduct or termination of any Chef or Candidate introduced by Atlantica. Atlantica shall not be liable for any indirect, consequential, incidental or special losses, including but not limited to loss of profit, loss of business, business interruption, reputational damage, event cancellation costs, travel expenses, accommodation expenses or replacement costs. Nothing in this Agreement shall exclude or limit any liability which cannot lawfully be excluded or limited under applicable law.

Complaints Procedure – 

  • At Atlantica Chefs we pride ourselves on our clients friendly policies. We aim to provide clients with an open transparent service that supports both our clients and the chef we introduce. If you feel we have fallen short of these high standards then please be assured that we will take your concerns seriously.
  • If you have a complaint about Atlantica, please write to:

On receipt of your complaint, we will send you a letter or e-mail, acknowledging your complaint and confirming its receipt. You should expect to receive this confirmation within 7 working days of us receiving your complaint. We will then record your complaint in our central register and start to investigate on your behalf. This is likely to involve the following steps:

1. Examining your records to ascertain the sequence of relevant events

2. Asking the member of staff with whom you dealt to provide a written response

A full response to your complaint will be drafted by Deniz Kurt or the chef coordinator who is dealing with your file. If appropriate, Deniz Kurt may wish to discuss the events surrounding your complaint directly with you, and, if appropriate, offer an apology.

We aim to acknowledge, investigate and resolve all complaints within 21 working days of receipt. 

ATLANTICA RESERVES THE RIGHT TO CHANGE OR AMEND OUR COMPLAINTS PROCEDURE WITHOUT PRIOR NOTICE.

Intellectual Property

Atlantica Private Chefs respects the intellectual property of its clients, members, requests its clients, users and members to do the same. If you believe that your work is being copied in such a way that violates your intellectual property rights, please contact the Atlantica Private Chefs as soon as possible.

All rights of reproduction of texts, images, logos, and any element of the pages of the Atlantica Private Chefs website cannot be reproduced, as a whole or in part, without specific and prior consent of Atlantica.

Any copy, in part or as a whole, for advertising or commercial purposes, on any medium whatsoever, is strictly prohibited and/or is subject to the prior written consent of Atlantica. Any request for authorization to copy must be sent to: info@atlanticachefs.com

We, as Atlantica Private chefs, follow a company policy that respects your personal data. Atlantica processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable Italian data protection laws.
